WASHINGTON — Senate Democrats are preparing to force a floor vote in the coming weeks on a resolution aimed at holding President Donald Trump’s administration accountable for its deportation practices, particularly in cases involving El Salvador.
Led by Sen. Tim Kaine of Virginia, the resolution is part of a growing strategy by Democrats to confront the administration through legislative avenues, even while in the minority. Kaine plans to introduce the measure Thursday, continuing a pattern of using “privileged” resolutions that compel a Senate vote regardless of Republican leadership’s wishes.
“These votes are all about curbing executive power,” Kaine said, referring to the broader campaign of Democratic resistance to Trump’s policies.
Focus on Wrongful Deportation Case
Central to the resolution is the case of Kilmar Abrego Garcia, a man deported to El Salvador despite a court ruling that his removal was unlawful. A federal judge in Maryland ordered the U.S. government to bring Abrego Garcia back, but the administration has so far failed to comply.
The resolution would require the Trump administration to report to Congress on how it is addressing such court rulings, including steps to reverse wrongful deportations. It also calls for more transparency on U.S. financial assistance to El Salvador and an assessment of the country’s human rights practices.
“We’re going to have a very long memory about this,” Kaine said, noting that U.S.-El Salvador relations will extend beyond Trump’s tenure.
Legislative Tools to Pressure GOP
Democrats have been under pressure from their base to oppose the Trump administration aggressively, even with limited procedural power. These resolutions, while often symbolic, force Republicans to publicly stake positions on controversial issues.
Sen. Chris Van Hollen of Maryland, a co-sponsor of the resolution, recently visited Abrego Garcia in El Salvador. He emphasized the resolution’s role in keeping the issue visible and pressuring the administration to comply with court orders.
“We have limited tools, but this is an effective tool,” Van Hollen said.
Democrats are using authority under the Foreign Assistance Act, which allows any senator to demand a vote on human rights-related resolutions. These privileged resolutions, much like those previously used under the Congressional Review Act, bypass traditional Senate procedures.
A Pattern of Resistance Votes
The El Salvador resolution follows several earlier votes initiated by Democrats targeting Trump’s economic agenda. In April, the Senate passed a resolution blocking tariffs on Canada. Another aimed at reversing broader tariffs was narrowly defeated, with a handful of Republicans joining Democrats on each vote.
This legislative maneuvering recalls tactics Republicans used against President Joe Biden, demonstrating how minority parties can still influence the national dialogue through procedural means.
Although the El Salvador resolution has little chance of passing in the Republican-controlled House, it serves a critical political function: placing Republicans on record regarding contentious aspects of Trump’s immigration policy.
“It’s a way of shining a spotlight on this issue,” said Kaine.
Republican Response Unclear
It’s uncertain whether any Republicans will support the new resolution. Most have backed Trump’s aggressive immigration and deportation stances, but there is growing unease about the administration’s apparent disregard for court decisions.
While the GOP remains broadly aligned with Trump’s border policies, individual members may be reluctant to appear dismissive of legal rulings or human rights concerns. However, internal GOP divisions have yet to significantly disrupt the administration’s immigration agenda.
