Federal Judge Tosses Michael Wolff’s Lawsuit Against Melania Trump

A federal judge in New York dismissed author Michael Wolff’s lawsuit against First Lady Melania Trump, sharply criticizing what she described as an improper attempt to gain legal advantage before Trump could sue him directly.

Judge Mary Kay Vyskocil ruled Friday that Wolff’s legal maneuvering amounted to “tactical gamesmanship” and declared the dispute should proceed through ordinary legal procedures.

The decision marks another major development in the ongoing legal clash involving comments Wolff made connecting Melania Trump to convicted sex offender Jeffrey Epstein.

In a 45-page decision, Vyskocil rejected Wolff’s attempt to proactively shield himself from future defamation litigation.

She wrote that Wolff’s approach was:

“Not how the federal courts work.”

The judge also accused the author of presenting the case in an abusive manner and said the court would not oversee what she described as:

“An abusively presented spat.”

Although she acknowledged that both sides clearly had a real dispute, Vyskocil concluded they must litigate the matter through standard channels rather than procedural maneuvering.

Wolff Filed Suit Before Melania Trump Could

Wolff initially filed the lawsuit in October after receiving a warning letter from Melania Trump’s attorney, Alejandro Brito.

The letter threatened a possible $1 billion lawsuit unless Wolff retracted statements allegedly causing:

  • Reputational harm
  • Financial damage
  • False public impressions

Rather than waiting to be sued, Wolff filed first.

He asked the court to declare:

  • He had not defamed Melania Trump
  • His comments were protected speech
  • Any future lawsuit against him would violate anti-SLAPP laws

SLAPP lawsuits — Strategic Lawsuits Against Public Participation — are often criticized as attempts to silence critics through expensive legal battles.

The controversy stems from comments Wolff made during interviews and online videos discussing Melania Trump’s relationship to Jeffrey Epstein’s social circle.

Wolff argued he never accused Melania Trump of involvement in Epstein’s crimes.

Instead, he claimed his remarks referred to:

  • Social connections
  • Political handling of Epstein-related controversies
  • White House management of public fallout

His lawsuit stated some comments were incomplete phrases taken out of context while others represented protected opinion.

Among the controversial statements were claims involving:

  • Donald Trump’s past association with Epstein
  • Melania Trump’s alleged presence in Epstein-linked social circles
  • Characterizations of the Trumps’ marriage

Melania Trump Publicly Denied Epstein Claims

Earlier this year, Melania Trump forcefully denied any connection to Epstein during a White House appearance.

“The lies linking me with the disgraceful Jeffrey Epstein need to end today,” she said in prepared remarks.

“The individuals lying about me are devoid of ethical standards, humility and respect.”

Her legal team has aggressively pursued responses to media reports and commentary connecting her to Epstein.

The Daily Beast Retracted Article

The legal controversy intensified after The Daily Beast retracted a July 2025 article titled:

“Melania Trump ‘Very Involved’ in Epstein Scandal: Author”

The article was based on comments made by Wolff.

According to Wolff’s lawsuit, the publication misunderstood or misrepresented what he intended to say.

He insisted his remarks referred only to Melania Trump’s handling of political fallout surrounding Epstein-related issues — not criminal activity.

Wolff Accuses Trumps of Intimidation Tactics

In court filings, Wolff accused the Trump family of using legal threats to intimidate critics and suppress speech.

He argued the Trumps routinely pursue costly litigation designed to:

  • Silence opponents
  • Discourage criticism
  • Pressure media organizations
  • Extract apologies or retractions

Wolff claimed the legal threats created:

“A climate of fear in the nation so that people cannot freely or confidently exercise their First Amendment rights.”

Judge Declines to Continue Federal Oversight

Although Vyskocil agreed federal jurisdiction technically existed, she declined to continue hearing the case.

Instead, she dismissed it entirely, stating the matter should proceed “like any other” legal dispute.

The ruling does not prevent Melania Trump from pursuing separate legal action against Wolff in the future.

Melania Trump Team Celebrates Ruling

A spokesperson for Melania Trump praised the outcome following the decision.

“She is proud to continue standing up to, and fighting against, those who spread malicious and defamatory falsehoods,” spokesperson Nick Clemens said.

The ruling represents another aggressive legal response by the Trump family against critics, journalists, and media organizations during Trump’s second term.

Epstein Associations Continue Haunting Public Figures

The case also highlights the continuing political and reputational fallout surrounding Jeffrey Epstein years after his 2019 death in federal custody.

Epstein’s connections to wealthy businessmen, politicians, celebrities, and global elites continue generating lawsuits, media investigations, and public controversy.

For public figures like the Trumps, even indirect associations have become politically explosive and legally sensitive.
